Terms and Conditions of Service

Welcome to The Literary Kingdom. By using Theliterarykingdom.com, you confirm that you unconditionally accept and agree to these terms of service. If you do not agree to our terms of service, you cannot use our website. Our Privacy Policy, which can be found here, is incorporated in these terms by this reference. All users must be at least thirteen years old.

You need an account

To view and engage with most of the features on our website, you will need to set up an account. To set up an account, you will need to register with your email address and choose a password.

You acknowledge that your account is unique and personal to you, and you are responsible for maintaining the security of your account and any account activity and purchases. If you share your username and password with anyone, they can take control of the account. In these circumstances, we are not liable for any of your or their actions. If you find out that someone has used your account without permission, please report it by emailing customer.support@theliterarykingdom.com. You agree not to impersonate someone you aren’t. You may never use another person’s account without their permission.

The Literary Kingdom may reclaim any username, at any time, which we believe violates another party’s intellectual property rights, is inactive, is considered inappropriate by The Literary Kingdom, or which could mislead other users. If we need to reclaim a username, you will be notified and asked to change your username to continue to have access to your account.

Content

It is important you read our content guidelines before you publish a book on our website.

When you use our services to publish a book, you are giving us permission under applicable copyright laws to display and sell the content to users of The Literary Kingdom.

You are responsible for the books that you publish, and other content that you post. This means that you assume all risks related to its publication and display, including someone else’s reliance on its accuracy and any claims a person might make relating to legal rights, for example those that relate to intellectual property or copyright. We may not monitor or control content published/posted on our services and we do not take responsibility for what our users publish/post. We do not support, represent, or guarantee the completeness, truthfulness, accuracy or reliability of any content or communications posted on The Literary Kingdom by its users. Whilst we take every reasonable action to remove inappropriate or harmful content, you understand that by using our services, you may be exposed to content that may be offensive, inaccurate, harmful or inappropriate, or deceptive. When content like this is reported, we will investigate it and it may be removed.

The Literary Kingdom may showcase your content to promote our services. We will never sell your content to third parties without your explicit permission.

If you submit your writing into one of our contests, or to be published in one of our collections, you may enter into additional or different terms and conditions, or agreements. In case of conflict, the terms and conditions for those entries will override those set out for standard publication.

Comments and Posts

By submitting comments on an author’s story, responding to someone in a forum or making a post from your account, and all other communication through our services, such as emailing us about our website, The Literary Kingdom will be free to use your text for any purposes, in all media, in perpetuity, owing no obligation or liability to you whatsoever, including, but not limited to the right to use, sell, display, exploit, publish, change, add to, and distribute it. This does not include the books that you publish.

How we handle copyright issues

If you would like to submit a claim for copyright infringement, please email customer.support@theliterarykingdom.com and use the subject “copyright infringement.” You will need to tell us:

• The title of the book
• Your username
• If you are reporting the copyright of the book or only part of it
• Your name and email address
• A statement by you that you have good faith that the content is not authorised by the copyright owner

We will also ask you to supply evidence to support your claim.

Users accused of copyrighting another person’s work will be investigated. The Literary Kingdom reserves the right to remove content alleged to be infringing copyright without prior notice, at our sole discretion, and without liability to the writer or anyone else. If it is proven that a user has published copyrighted work, we may terminate their account.

Our Don’ts list

When you sign up, there are restrictions you agree to. We call them our don’ts, and they exist to make your experience on our platform enjoyable. If you are using our website:

• Don’t steal content from our The Literary Kingdom or our users
• Don’t try to damage or disrupt The Literary Kingdom website or services
• Don’t break the law (for example, by posting/publishing copyright material you don’t own, or by violating people’s rights)

You will not cause damage to The Literary Kingdom, or impair the availability or accessibility of The Literary Kingdom in any way that is fraudulent, unlawful, harmful, or illegal, including, but not limited to, bypassing, adapting, or hacking our platform to change, destroy or limit the functionality of our website and services, of other users computer software, hardware or telecommunications equipment, or attempt to gain unauthorised access to our services or computer system. You must not misuse our platform by introducing viruses or any other malicious material or harmful technology. You must not attempt to gain unauthorised access to The Literary Kingdom website. You must not attack The Literary Kingdom via denial-of-service. The Literary Kingdom will report any breaches to the relevant law enforcement.  

Deleting your account

You can delete your account at any time. If you have subscribed to our monthly membership, you need to give us thirty days’ notice. If you have subscribed for an annual membership, The Literary Kingdom will not refund you if you cancel your subscription six months into your membership.

The Literary Kingdom reserves the right to suspend or terminate your account and all content included therein, at any time, for any reason at our discretion, including if you fail to comply with the terms and conditions set out here. If your account is suspended or terminated, The Literary Kingdom will not be liable to you for your inability to access any content you published or shared, purchased or otherwise, on our account.

The Literary Kingdom’s liability

When you use our services, you release The Literary Kingdom from any claims, damages, and demands, known or unknown, disclosed or undisclosed, from disputes between users or users and third party services.

The Literary Kingdom will not be liable for any damages that arise from your use of our services. This exclusion includes, without limitations, where services are hacked or unavailable (for example, because of technical problems or site updates), all types of damages, no matter the type of claim or loss, and any lost profit.

You may find links on our website to other websites. When you access third-party websites, you do so at your own risk.

The Literary Kingdom takes no responsibility for any comments, posts, messages, or other works posted/ published by users which is lost or deleted in the process of it being uploaded, or otherwise. 

Your Liability to The Literary Kingdom

If your actions cause our company to be sued, or if you break any aspect of our terms and conditions or policies, you will compensate us for any liabilities or losses, claims, and expenses (including legal fees) that arise from your misuse of our site.

You understand you are responsible for all costs associated with accessing and using The Literary Kingdom services, including, without limitation, subscription fees, any services or products we offer, the purchase of books, or mobile device fees.

You will keep confidential any correspondence and discussions that you have with The Literary Kingdom concerning disputes regarding your payment history, or otherwise (for example, any information you learn in the course of a lawsuit), or any alleged breach of these terms and conditions by you, The Literary Kingdom, or a third party, without written consent of The Literary Kingdom.

Reservation of rights

We reserve the right to suspend, withdraw, discontinue, limit or change all or any part of The Literary Kingdom website, your access to our platform, or your use of The Literary Kingdom platform, without notice, for any reason, with or without cause, at any time, at our discretion. We reserve the right to change how we operate.

Advertising

The Literary Kingdom website may contain links or embedded material to third-party content, which The Literary Kingdom has not reviewed, including, but not limited to, other websites and third-party services, for advertising purposes, for the convenience of visitors/ website users, or for functions related to our business. The Literary Kingdom linking or embedding to third-party content, websites, services, products, or other, does not imply advertisement or endorsement.

When you access third-party websites, you do so at your own risk, and you may be subject to the third party’s website terms and conditions. We are not responsible for any third-party content linked or embedded to our website and disclaim any responsibility for the accuracy of information found on these sites, or the quality of their products or services.

Changes to our terms and conditions

We may change our terms and conditions at any time. The Literary Kingdom will notify you of any changes made, and we will make visible to you the last date of updates introduced. If you disagree with any of the changes, you should close your account. Your continued use of our services after we send notice about our changes means you are agreeing to our terms and conditions.

Disclaimers

The Literary Kingdom may use various technologies and other methods to verify your compliance with these terms and conditions. You consent to The Literary Kingdom using monitoring technology and other methods to monitor your access to and use of our platform.

Views expressed on The Literary Kingdom by its users do not necessarily represent our views or values.

The Literary Kingdom does not guarantee to monitor all the content posted, published, or shared by its users, for offensive, indecent, or unlawful works.

The Literary Kingdom does not guarantee the delivery, performance, pricing or quality of any work published on our platform.

You understand that The Literary Kingdom is not liable for any failure of performance because of any cause outside of our control, including, for example, but not limited to, acts of God, fire, terrorism, supplier failures, breaches, or government requests.

We do not verify the identity of our users and therefore we do not guarantee that any user is who they claim to be.

While we’re committed to protecting your privacy in accordance with applicable laws and our policies, you understand that no electronic transmission of information can be guaranteed to be completely safe and The Literary Kingdom does not ensure the security of any information you transfer. You acknowledge all the information you provide is done at your own risk and may not be confidential.

You understand that The Literary Kingdom is under no obligation to become involved with any dispute between you and a third party or other service user.

If your content is infringed upon by a third party or other individual, The Literary Kingdom will have no responsibility or obligation to pursue intellectual property claims against such a third-party on your behalf. Now will we have a responsibility to issue intellectual property take down notices on your behalf.

Limitation of liability

The Literary Kingdom will not be liable to you for any direct or indirect damages of any kind, that are related to The Literary Kingdom, regardless of legal theory (including but not limited to property damage or personal injury), whether or not we have been advised of the possibility or probability of damages, and even if the policies, procedures, website design or otherwise set up to remedy these damages fail to meet their purpose.

Furthermore, you waive and release The Literary Kingdom, its directors, employees, affiliates, and other stakeholders, from any claims or damages of any kind, that may arise directly or indirectly from the use of our platform, including, but not limited to, the loss of data, content, intellectual property, damages caused by malicious software, fraud, any breach in our terms of service by you, or any other breach beyond our control.

Indemnification

You agree to indemnify, defend, and hold harmless, The Literary Kingdom, including its members, employees, directors, suppliers, affiliates, officers, partners, agents, lawyers, licensors, and contractors, against all claims, liabilities, damages, losses, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses (including reasonable legal fees) that may arise in connection with your use of our platform, your breach of these terms, or your violation of any law or the rights of a third party.

This indemnification obligation will survive the termination or expiration of your account and the use of the platform.

Competition entries and anthology submissions

The Literary Kingdom may offer competitions, special programs, promotions, and anthology publication opportunities may have unique rules different from these terms and conditions. In case of conflict or inconsistency, the terms and conditions for the promotion/competition will take priority over these terms and conditions. All terms and conditions for these will be provided. You should always review these terms and conditions and/or rules as your participation constitutes as your acceptance and agreement of those terms and conditions.
